What should I do if the police arrest me?

Can the police still take action if the allegation is from years ago?
Usually, the alleged sexual offence is reported quickly, and the police take action. However, recently, mainly due to increased medial reporting, many historic offences are being reported. These can be decades after the alleged offence.
In the majority of cases, the police will arrest you and interview under caution at the police station. To arrest you, the police only require a reasonable suspicion that you have committed an offence.
The police are duty-bound to investigate new and historic offences. After the interview, the police are likely to continue investigating the allegation before sending their findings to the Crown Prosecution Service (CPS). They will then decide to charge you or take no further action. They will charge the alleged offender if they believe they have enough evidence to secure a conviction.
What happens if I'm charged with a sexual offence?
If you’re charged with offences such as downloading indecent images, revenge porn, sexual assault, assault by penetration or rape, you are at risk of a considerable prison sentence. You will require specialist help from criminal defence lawyers who are used to dealing with offences of this nature.
What will happen at court?
Most sexual offences will be dealt with at the Crown Court. After considering the police station interview, the evidence disclosed by the CPS, and your account, we will advise you as to your options. This being a guilty plea, or a not guilty plea with the matter going to trial.
If you have a defence, your team will explain the procedure to you, including the benefits and risks of taking the matter to trial, such as the loss of credit for a guilty plea, should you be found guilty.
Further, if we advise you have no defence, and you choose to plead guilty, we will offer mitigation to secure the most lenient sentence for you.
